Terms of Service

These terms cover your use of PEARatings at pearatings.com (the "Site"). By using the Site, you agree to them. If you don't agree, please don't use the Site.

PEARatings is an independent, one-person project. It is not affiliated with, endorsed by, or sponsored by the NCAA, the NAIA, any athletic conference, or any college, university, or athletic department. Team names, logos, and marks belong to their owners and appear on the Site only to identify teams.

Schedules, scores, and statistics come from publicly available sources, such as official NCAA and NAIA statistics and school athletic websites. PEAR's ratings and metrics, including TSR and PCR, are built and calculated by PEARatings. Ratings from other systems that appear for comparison belong to the people who created them.

Every rating, projection, spread, win probability, simulation, and graphic on the Site is the output of a statistical model or a summary of public data. It is meant for information and entertainment. Models miss, source data has errors, and updates can run late, so nothing on the Site is guaranteed to be accurate, complete, or current.

The Site and everything on it are provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of accuracy, reliability, fitness for a particular purpose, or non-infringement.

PEAR's numbers are not betting, financial, or any other kind of professional advice, and a spread or win probability is never a recommendation to place a wager. Any decision you make using the Site, including any bet, is your own decision and your own responsibility. Don't rely on the Site alone for anything that matters.

Writers, broadcasters, and fans are welcome to reference and share PEAR's ratings and graphics. Please credit "PEAR" or "PEARatings" when you do, and don't present PEAR's work as your own. Please also don't use scrapers or other automated tools in a way that overloads or disrupts the Site.

The Site shows ads from third parties and links to outside services such as X (Twitter) and Buy Me a Coffee. PEARatings doesn't control those ads or services and isn't responsible for them. Support contributions are optional and are handled by the service you use to make them. The Privacy Policy explains how advertising and analytics cookies are used.

To the fullest extent the law allows, PEARatings and its owner are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including lost money, lost profits, or wagering losses, that come from using the Site or from being unable to use it. This applies under any legal theory, including contract, tort, negligence, or strict liability, even if PEARatings was told such damages were possible.

If someone brings a claim against PEARatings or its owner because of how you used the Site or its content, you agree to cover the resulting losses and costs, including reasonable attorneys' fees.

These terms may change. Changes take effect when they are posted here, with a new effective date at the top, and continuing to use the Site afterward means you accept them. These terms are governed by the laws of the jurisdiction where the Site is operated, without regard to conflict of law rules. Questions can go to pearatings@gmail.com.
